In Canada’s category-based lotteries, you are considered a candidate for an invitation only on the day the lottery itself is held — if you have already accumulated the required work experience by that time. An invitation received before you gained the necessary experience does not make you a valid applicant: if you submit an application without the required experience, it may become grounds for rejection.

How it differs from the Canadian Experience Class program

The Canadian Experience Class (CEC) program works differently. Here, the work experience that matters is not on the day of the lottery, but on the day you submit your permanent residence application. Even if you received an invitation early and haven’t yet accumulated all the months, you can continue working, gaining experience, and submit your application when you’re ready. The system typically reserves points for your work in advance, usually for one or two months ahead.

For category-based lotteries, this is impossible. The ministerial instructions clearly state: you fall into the category and are eligible for an invitation only if you have already worked the required period by the time the lottery itself is held.

What the ministerial instructions say

All rules for category-based lotteries are set out in the Ministerial Instructions Respecting Invitations to Apply for Permanent Residence document on the IRCC website.

The instructions state:

  • The category is established for a specific period — for example, between October 1 and October 31.
  • You are considered a member of this category if, on the day the category is established (that is, on the day of the lottery), you have already accumulated at least one full year of full-time work (or equivalent part-time) in one of the approved occupations.
  • If you do not meet this condition on the designated date, you are not eligible to participate in this particular lottery.

This is the key difference from the Canadian Experience Class program, where the decisive date is the day you submit your application, not the day of the lottery.

What happens if you receive an invitation early

If you received an invitation before you completed a full year of work, you are in a risky situation. The invitation has not changed the rules — it has only changed the fact that the system calculated your points in advance.

The responsibility for meeting the requirements rests with you. When you submit your application, IRCC will check: were you actually a candidate on the day of the lottery? If not, it may result in a rejection. According to specialists, cases of rejection on this basis have not yet been documented, but this does not mean they are impossible — it means the check can occur later, after submission.

How to verify your category requirements

Go to the IRCC website and navigate to the section on invitation rounds. Find your category-based lottery (for example, Trade Occupation Category — the last one was for trades occupations). Click on the link “See full text of ministerial instructions”.

In the document, find the section on who falls within the category. It will specify the requirements for work experience, its duration, and the period over which this experience must be accumulated (usually the last three years). Check the date the lottery was held and confirm that by that date you had already met all requirements.

The main rule for category-based lotteries

Do not rely on a received invitation as a guarantee. If you have doubts about whether you will have time to accumulate the remaining days of experience before submitting your application — it is better to wait for the next lottery and be fully confident in your compliance with the requirements.

Your invitation will be valid for a certain period (usually several months). If you submit an application without having worked the required experience on the day of the lottery, it could be interpreted as improper use of the invitation, even though you did receive it.
