In September, IRCC updated instructions for code C13, which exempts workers from the work permit requirement and allows employers to invite equipment repair specialists. The code has been in place for some time but is underused—the update clarifies two types of workers and the conditions for their entry.

Two Types of Workers Under Code C13

The exemption from the work permit requirement applies to specialists in two categories. The first consists of emergency repair workers—individuals whose arrival in Canada is necessary to perform urgent repairs on industrial or commercial equipment. Such repairs are needed to prevent job losses: if machinery breaks down and is not repaired promptly, it can disrupt operations at a business employing Canadian citizens or permanent residents.

The second category comprises specialists in repair of out-of-warranty equipment. This equipment is no longer covered by a warranty, is not part of a leasing agreement, and is not covered by a post-warranty service agreement. In this case, a specialist may come to Canada to perform preventive maintenance to avoid equipment failure and productivity decline.

Admission Conditions and Requirements

Workers in both categories are typically invited to Canada for a short period—up to 30 days. To qualify under code C13, a foreign national must possess specialized knowledge necessary to repair the specific equipment on which they will work. In other words, their qualifications must meet the requirements specified in the work permit application.

For specialists repairing warranty equipment, there is an additional requirement: the equipment manufacturer (OEM) must not have a commercial presence in Canada. Additionally, the lack of timely repairs must have a serious impact on employment in the country.

Time Limitation and Extension Possibilities

The main limitation of code C13 is the short duration of the permit, which is issued for a period of up to 30 days. However, in some cases, extensions or connections with other procedures may be possible, which could give the specialist more time to complete the work.
