What IRCC does and what it doesn't

Immigration, Refugees and Citizenship Canada (IRCC) is the federal department that decides who may visit, study, work or settle permanently in Canada and who becomes a citizen. It operates under the Immigration and Refugee Protection Act and the Citizenship Act, and was known as Citizenship and Immigration Canada until 2015. Most applications, from work permit extensions to Express Entry profiles, are filed through an IRCC secure account or the Permanent Residence Portal.

IRCC is often confused with other bodies that share the immigration process. Employment and Social Development Canada issues the LMIA that many employer-specific work permits require, the Canada Border Services Agency handles entry at the border, and the Immigration and Refugee Board, an independent tribunal, decides refugee claims and immigration appeals. When an IRCC officer refuses an application, the applicant can seek leave for judicial review at the Federal Court, which can send the file back for a new decision but does not issue the visa or permit itself.
