TPS for Ukrainians has been automatically extended for 6 months until April 19, 2027. This creates a window for those who entered on a nonimmigrant visa and obtained TPS within the US to change their status. EB-1A, EB-2, EB-5, H-1B, E-2, and O-1 visas are realistic options.
How TPS Auto-Extension Occurred
TPS extended for 6 months automatically because the Department of Homeland Security took no action within 60 days before the previous status expired. This is the third extension: the first TPS was the initial designation, the second ends October 19, and the third ends April 19, 2027.
Auto-extension means TPS holders gained additional time for planning, but it does not guarantee the status will be extended again. Counting on another extension would be unwise.
Who Can Change Status Right Now
The opportunity to change status is available only to those meeting specific conditions. If you obtained TPS and were previously in the US on a nonimmigrant visa (not political asylum and without other immigration statuses), you can apply for a new status from within the country.
Those who were on political asylum and then obtained TPS do not have this option. For those on U-4 without TPS, there is only one path: leaving the US to obtain any visas.
Realistic Visa Options and Timelines
Until April 19, 2027, you can apply for:
EB-1A — category for individuals with extraordinary ability. To start, four criteria are needed: critical role in the industry, contribution to your field, above-average salary, and judging or evaluation by other professionals. Competitions are not required — assessments can come from routine work. It is advisable to have multiple examples in each criterion rather than just one.
EB-2 — for professionals with advanced degrees or extensive experience. This category is also realistic for strong cases that can be prepared within 6 months.
EB-5 — investment visa. Available only if you have a funded project with a business plan and an interested US organization, or if you have $800,000. It is best to apply before September 30, 2026; the second window is before September 30, 2027.
Nonimmigrant visas: H-1B, E-2, and O-1 can realistically be assembled within 6 months. O-1 for individuals with extraordinary ability has a 97% approval rate and is considered the most accessible and straightforward option at this time. O-1 also opens a path to a green card through EB-1A.
Why You Cannot Count on Another Extension
One might assume TPS will be extended again, but relying on this is risky. If the status is not extended and you have no U-4 or other status, you will have to leave the US. After departure, any re-entry goes through an embassy, which carries a certain risk of refusal. If you can avoid an embassy interview, remain in the country, and change status from within, this opportunity should be taken now.
The US provides a second chance, but you must seize it. Hoping for improved conditions or new rules is unreasonable when you have the opportunity to act today.
