Reporting modern slavery to the National Referral Mechanism doesn’t automatically extend your visa. Section 3C leave status (deportation pause protection) depends only on a current visa or other active applications to the Home Office, not on whether you’ve filed an exploitation report.
When section 3C leave applies and when it stops
Deportation pause protection (section 3C leave) continues only if you have a current visa or another immigration application already submitted to the Home Office. If your visa has expired, section 3C leave stops regardless of whether you file a modern slavery report.
Examples of active applications that maintain your status: FLR (further leave to remain), a current Skilled Worker visa, or other active immigration proceedings with the Home Office.
What happens when you report modern slavery
When you file a modern slavery claim through the NRM or another competent authority, that authority conducts an investigation. Its task is to determine whether you are actually a victim of modern slavery. This investigation has no bearing on your immigration protection.
A modern slavery claim doesn’t pause the countdown to your visa expiry, because the investigation and immigration process are separate matters. During this time, the Home Office doesn’t extend your status or recognize it as continuing.
Recognition as a victim and status change
If the competent authority (a public or private body conducting the investigation) decides you are indeed a victim of modern slavery, a second stage begins. You then contact the Home Office and provide this decision.
The Home Office doesn’t issue a new visa. Instead, the service amends your existing visa to reflect your victim status. This means the remaining time on your current visa continues to count down, but under new conditions.
Employment independence after recognition
After your modern slavery claim is approved, you gain independence in choosing your employer. You’re no longer tied to the original sponsor who exploited you.
You can work in any sector, regardless of your previous job’s industry—for example, move from healthcare to manufacturing or another field. Work remains mandatory, but your choice of employer is completely free.

Path to ILR (indefinite leave to remain) after recognition as a victim
After your status is updated, the Home Office begins counting time based on your current visa. For example, if your visa was for three years and two years remain, you use those two years fully with your new rights and independence.
After the statutory period is complete (for modern slavery victims, this is typically five years), you can apply for ILR (Indefinite Leave to Remain). The requirements are the same as for other immigrants: you must pass the English language test and the Life in the UK test, if applicable. Special concessions on these tests for modern slavery victims are not provided.
Common misconception
Many people wrongly believe that simply filing a modern slavery report automatically protects their immigration status, especially if their visa is about to expire. This is untrue. The competent authority will conduct its investigation, but during this time the Home Office doesn’t recognize your status as extended and doesn’t cancel visa expiry dates. Your status depends on whether you have another current immigration permission, not on filing a modern slavery report.
