How the UK visa system works

UK immigration policy is set by the Home Office, and visa applications are decided by its UK Visas and Immigration (UKVI) directorate under the Immigration Rules. Changes to those rules are made through Statements of Changes laid before Parliament, which is why requirements can shift several times a year.

Since free movement with the EU ended in January 2021, most work migration runs through a points-based system. The Skilled Worker route requires a job offer from an employer holding a Home Office sponsor licence, and the sponsor must assign a Certificate of Sponsorship and meet ongoing compliance duties, or risk having the licence suspended or revoked.

Global Talent works differently: it needs no job offer and is aimed at leaders or emerging leaders in research, arts and culture, and digital technology. Most applicants first obtain an endorsement from a designated body, such as Arts Council England for the arts, before applying for the visa itself, and the route can lead to indefinite leave to remain.
