Holders of temporary protection in Spain can obtain a regular residence permit without waiting for months. In practice, the entire process — from submitting documents to receiving a decision — took two weeks, but timelines depend on the workload of local authorities and the caseworker handling the application.

When to transition to a residence permit

If a Ukrainian refugee receives income outside Spain and does not work within the country, one of the optimal options is a residence permit based on vulnerable status (the so-called argo social). To obtain such a status, employment on Spanish territory is not required, which simplifies the procedure for those conducting remote work or receiving financial support from abroad.

Required documents

A certificate of no criminal record with apostille and translation is required. A certificate of social integration (certificado de integración social) is needed, which is issued by the municipality (ayuntamiento). Bank statements must be attached to confirm account activity.

Also required is a certificate of residence in Spain, a temporary registration certificate (historial de empadronamiento) indicating addresses and periods of residence since arrival. All pages of the foreign passport must be scanned. A state fee must be paid.

Submission and review process

Documents can be submitted online. After submission, the authorities (extranjería, the department for foreign affairs) may request additional documents and an explanatory note. In that case, you will need to clarify the source of income, provide bank statements for a year, and submit an official document explaining the reasons for obtaining this type of residence permit and the reasons for transitioning from temporary protection.

In the case described, a positive decision was received 11 days after resubmission of documents.

Obtaining the resident card

After a positive decision, you need to schedule a fingerprinting appointment (dactyloscopy). Before this procedure, you must formally renounce temporary protection. The renunciation can be done in two ways: submit a request through the registry (registro general) — usually a response comes within 3–6 months, or visit the extranjería office in person without an advance appointment.

In the case reviewed, protection was renounced in person on the same day the documents for obtaining protection were submitted. After this, you must undergo fingerprinting, and within 30 days the new resident card will be ready.

Variation in timelines

The time to review the application and receive a decision depends on the workload of the extranjería office and the specific caseworker handling the case. There have been instances where the process extended over several months. Sometimes the application was denied, but court appeals resulted in a positive outcome.
