Since 28 August, the UK Home Office has introduced a new rule: if you have submitted a visa application and booked biometrics on 30 September or later, you must complete your biometric scan within 17 working days from the date of submission. If you fail to attend within this timeframe, your visa will become invalid, and using a variation of your application to defer the deadline will no longer be possible.
How it worked before
Previously, the system was more flexible. If you submitted an application and booked biometrics, you could submit a second application without completing the first one. In such cases, your initial visa application would be automatically cancelled, and the Home Office would refund the full visa fee and the NHS surcharge. Applicants also had the option to submit a variation of an existing application to request additional time or defer their biometric appointment. This rule was often used as a way to create an interim period while the main biometrics appointment was pending or being pushed further into the future.
New rule from 28 August
If you have submitted an application of any type — through the family route, partner route, private life route, outside immigration rules, skilled worker route, student route, or any other route via the Home Office — and booked biometrics on 30 September or later, you are required to complete your biometric appointment within 17 working days from the date of application submission. If you fail to attend within this timeframe, your application will become invalid. This applies to all visa types without exception.
What happens if deadlines are missed
If you do not complete your biometrics within 17 working days, document 3C (proof of your valid status) will become invalid. If you subsequently attempt to submit a variation of your application, the overstay period will be calculated from when your previous visa expired, not from the date of your new submission. This means you could acquire the status of an immigration rule breaker.
Application variation: still possible
It is important not to be confused: application variation has not been cancelled and remains available. However, it now works differently. If you submit an application and complete your biometrics within 17 working days, you will have a valid active application. After that, you can already submit a variation. But if you fail to complete biometrics within the deadline, your initial application becomes invalid, and the opportunity to use a variation as a tool for deferral no longer exists.
Who is affected
The new rule applies to all visa categories, but only if biometrics are booked for 30 September 2026 or later. If you have already booked biometrics for an earlier date, the old rules still apply. Additionally, the Home Office may make changes to the procedure, so it is recommended to check official updates before submitting your application.
