President Trump has repeatedly stated that talented graduates of Indian colleges should not leave the United States. The O-1 visa offers an alternative amid tightened H-1B requirements: a high approval rate and the ability to apply without employer sponsorship.
Why Talented Indians Leave the USA
Graduates of American colleges, including those from India, are forced to return home because they cannot stay for work. According to the politician, many then start businesses in their own countries and become multibillionaires, hiring thousands of employees. These same companies and this economic contribution could have remained in the USA.
Against the backdrop of growing criticism of H-1B and tightened policies on work visa sponsorship, employers are scaling back support programs for foreign employees. The federal government is introducing new fees, tightening inspections, and encouraging citizens to report minor violations. This makes obtaining H-1B increasingly difficult.
O-1 Visa as an Alternative to H-1B
The O-1 visa is intended for foreigners with outstanding ability in arts, science, education, business, or sports. According to USCIS statistics, of 31,681 petitions filed, more than 29,700 were approved, constituting more than 94% approval rate. This is significantly higher than H-1B lottery rates.
Differences between O-1 and H-1B: no lottery, no requirement for an LCA (Labour Condition Application) form, minimum salary threshold, filing possible at any time of year, and unlimited number of applications.
O-1 Visa Requirements
To obtain an O-1 visa, you do not need to meet all criteria. Any three of the following are sufficient:
— published research papers and citations; — use of your work in industry on a large scale; — experience judging or reviewing the work of other professionals; — membership in professional organizations intended exclusively for the top 10% of specialists; — salary higher than average in your field; — critical role in an organization, without which disruption would occur; — awards at national or international level; — recognition in mass media.
Politician Trump previously noted that in the USA, the share of immigrants selected by skills is only 12%, whereas in Canada, Australia, and New Zealand, this figure reaches 60–75%.
Two Ways to File for O-1
Option one: find a company sponsor, as with H-1B. The company files a petition, and you receive the visa.
Option two: if the employer is not ready to sponsor officially, create your own independent contractor business or file an application through an intermediary. In this case, you need to have a letter of intent or contract from the employer who will pay you salary, although they will not officially sponsor you. This is completely legal. This way you can work on contracts or W2 basis with multiple companies simultaneously, avoiding the need to find an employer willing to officially sponsor the visa.

Can Everyone Apply for O-1
The visa is not available to everyone, but almost anyone can prepare their profile within 7–8 months or at most a year to meet O-1 requirements. This does not mean starting from scratch: many people already meet the necessary criteria. The profile can be improved systematically and honestly, based on real career achievements.
