How employment abroad is regulated

Working in another country usually rests on two separate things: the right to work, granted by an immigration authority, and the employment contract itself, governed by local labor law. A work permit often depends on a specific job offer, so losing a job can affect immigration status, while protections such as dismissal procedures and anti-harassment duties generally cover foreign employees as well as local ones.

In Canada, many employer-specific work permits require a Labour Market Impact Assessment from Employment and Social Development Canada, and IRCC separately checks whether the job offer is genuine. Provinces can also select workers through Provincial Nominee Programs such as the Ontario Immigrant Nominee Program, whose nomination supports an application for permanent residence. In the United States, most employment-based green cards need an employer sponsor, but the EB-1A category lets a person of extraordinary ability self-petition on Form I-140.

In Germany, an employer planning to dismiss a worker on suspicion of misconduct is generally expected to hear the employee first, and where a works council exists, it must be consulted before any dismissal.
