Migration policy covers the rules and decisions governments use to decide who may enter, stay, work, study, settle or naturalize, and how asylum claims are handled. It is broader than immigration law: alongside statutes, it includes annual planning levels, funding choices, executive orders and the positions parties take in election campaigns.
Who makes these decisions differs by country. In the US, Congress writes the Immigration and Nationality Act, while presidents can restrict entry by proclamation under section 212(f), and federal courts can block such measures with injunctions. In Australia, the federal government sets the permanent Migration Program each year, and the Department of Home Affairs administers visas such as subclass 482. In the UK, the Home Office changes the Immigration Rules through statements laid before Parliament.
Within the EU, asylum is governed by common legislation, including the Pact on Migration and Asylum adopted in 2024, but citizenship and naturalization rules remain national. The Migration Policy Institute, a Washington-based think tank often quoted in this field, analyzes these policies but has no power to set them.
